1. Acceptance of Terms

Welcome to eHelpLab. By accessing or using our website, mobile applications, or any of our services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

eHelpLab reserves the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

2. Description of Services

eHelpLab provides a free consumer account for keeping track of applications you have submitted to other organizations. Our Services consist of:

  • Application tracking — a private record of applications you add yourself, with a status you set and can change
  • Verified account access — confirming that a mobile number you provide belongs to you, and keeping your information out of the messages we send
  • Notification settings — your choices about whether we contact you by text message

eHelpLab is not the organization you applied to. We do not review, decide, approve, deny, or otherwise influence any application; we do not contact any organization on your behalf; and we do not score, rate, or rank you. The information in your account is information you entered, and we are not responsible for its accuracy or completeness.

The Services are provided free of charge. Creating an eHelpLab account is never required to submit, complete, or continue an application with any company, and choosing not to create one has no effect on any application.

3. Eligibility

The Services offered on this website are not available to persons under the age of 18. By using our Services, you represent and warrant that you are at least 18 years of age and are a legal resident of the United States. You also represent that you have the legal capacity to enter into binding agreements.

4. User Responsibilities

When using our Services, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Use the Services only for lawful purposes
  • Not attempt to interfere with or disrupt our Services
  • Not impersonate any person or entity

5. Communications Consent

Providing a mobile number is optional and is not required to create or use an eHelpLab account. If you provide one, we send a single text message containing a one-time verification code to confirm the number belongs to you. That verification message is the only text we send before you opt in to a messaging program.

We operate two separate, independently optional messaging programs. Both are off unless you turn them on, and you may enroll in one, both, or neither:

  • Account Notifications — recurring automated text messages about applications you added to your account, including check-ins on applications awaiting an answer, reminders you set yourself, and notices that there is an update in your account to review. These messages link to your account and do not contain your personal details.
  • Marketing Messages — recurring automated text messages containing offers, new features, and news from eHelpLab.

You are not required to consent to either program as a condition of purchasing any property, goods, or services. Declining or later cancelling either program has no effect on any application you have submitted, and does not affect the other program.

Message and data rates may apply. Message frequency varies based on your settings and on how many applications you are following and how often they change. You may opt out at any time by replying STOP to any message, by changing your notification settings, or by contacting us directly. Reply HELP to any message for assistance and our contact information.

By providing your phone number, you acknowledge that you may receive communications even if your number is registered on state or federal Do-Not-Call lists, as these communications are related to your account and requested services.

6. Mobile Data Protection

eHelpLab does NOT sell, share, rent, or disclose your mobile phone number, personal data, or any other information to third parties for any purpose whatsoever.

Your data is used solely for the purposes of providing our Services, including account notifications and marketing communications (if opted in). We do not share your data with any third parties under any circumstances. We are committed to protecting your data and maintaining your privacy.

7. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of eHelpLab or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. eHelpLab does not warrant that the Services will be uninterrupted, error-free, or completely secure.

Our Services are not intended as a substitute for professional advice. You should consult with appropriate professionals before making decisions based on information obtained through our Services.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, eHelpLab AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID TO eHelpLab IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless eHelpLab and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or related to your use of the Services or your violation of these Terms.

11. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Salt Lake City, Utah.

YOU AGREE TO WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION.

Any claim or cause of action arising out of or relating to these Terms or the Services must be commenced within one (1) year after the claim or cause of action arose; otherwise, such claim or cause of action is permanently barred.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions.

13. Termination

eHelpLab reserves the right to suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
